Another Part of our Criminal Justice System<\/span><\/b>&nbsp; [second daily dose of <i>Criminal Defense Work<\/i>]<\/p>\n<p>Now I have lots of questions, but Harrison\u2019s certainly not the monster one might have qualms about defending and he had no prior criminal record.&nbsp; My questions go along the lines of what evidence would make him guilty or innocent in the eyes of a jury.&nbsp; Did they force themselves on her?&nbsp; How do you know she was willing?&nbsp; Was she drunk?&nbsp; Was she really having sex with others that day?&nbsp; Are you guys really friends, and, if so, why would she accuse you and Latrelle but not the others?&nbsp; Harrison had answers for every question but the last one.&nbsp; There was no force.&nbsp; She never objected.&nbsp; She\u2019d been drinking, but wasn\u2019t drunk.&nbsp; And yes, there were at least three other guys who\u2019d say they had sex with her that day, and on many days before.<\/p>\n<p>If the jury believed Harrison\u2019s story, he\u2019d likely be found innocent.&nbsp; But Julie had a different version, as contained in the police report.&nbsp; (By rule I could not force her to speak with me \u2013 and that didn\u2019t happen.)&nbsp; Julie told the cops she was forcibly raped \u2013 no bruises, just held against her will despite her pleas to stop.&nbsp; Now my questions went along the lines of:&nbsp; Is she lying and is there a way to prove it?<\/p>\n<p>Latrelle had the same story as Harrison\u2019s, but there were no other eyewitnesses.&nbsp; Yes, the others at the party were willing to testify but the Judge made a ruling in advance of the trial that any other sex acts on her part would not be allowed as evidence based on Minnesota\u2019s \u201cRape Shield Law\u201d \u2013 just because a woman engages in sexual relations with others doesn\u2019t mean this episode is consensual.&nbsp;&nbsp;&nbsp;&nbsp; <b>&nbsp;<\/b><\/p>\n<p>Latrelle had his own lawyer, and by rule there would have to be two jury trials.&nbsp;<a href=\"http:\/\/andydawkins.com\/wp-content\/uploads\/2015\/02\/a-judge-at-age-56.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-medium wp-image-1052\" alt=\"a judge at age 56\" src=\"http:\/\/andydawkins.com\/wp-content\/uploads\/2015\/02\/a-judge-at-age-56-199x300.jpg\" width=\"199\" height=\"300\" srcset=\"http:\/\/andydawkins.com\/wp-content\/uploads\/2015\/02\/a-judge-at-age-56-199x300.jpg 199w, http:\/\/andydawkins.com\/wp-content\/uploads\/2015\/02\/a-judge-at-age-56-681x1024.jpg 681w, http:\/\/andydawkins.com\/wp-content\/uploads\/2015\/02\/a-judge-at-age-56.jpg 1589w\" sizes=\"(max-width: 199px) 100vw, 199px\" \/><\/a> The Judge flipped a coin for who would get tried first.&nbsp; We won the toss and, of course, elected to go second.&nbsp; I watched all three days of Latrelle\u2019s trial before an all-white jury \u2013 Julie, white, petite and only 19 years-old, was a very sympathetic witness; Latrelle, like Harrison, was a stripling, young, muscular Black man \u2013 it was no contest.&nbsp; It took the jury only 45 minutes to convict for first degree criminal sexual misconduct, and the Judge immediately departed <span style=\"text-decoration: underline;\">upwards<\/span> from the sentencing guidelines and imposed a ten year sentence.<\/p>\n<p>Well, I\u2019m not sure all this fits with my sense of fairness \u2013 but all very real nevertheless.&nbsp; So I tell Harrison I think I can work a plea bargain for him to plead guilty to <span style=\"text-decoration: underline;\">third degree<\/span> criminal sexual misconduct and only face 12 months in the workhouse for his sentence.&nbsp; \u201cBut I\u2019m not guilty!\u201d he says.<\/p>\n<p>\u201cWell,\u201d I tell him, \u201cYou may not be guilty of rape, but you\u2019re sure guilty of some very poor judgment; you took advantage of someone who needed a true friend; can\u2019t you see her pulling train was due to her insecurities?&nbsp; To Harrison\u2019s credit \u2013 he really was a decent human being \u2013 he saw that I was right, and could live with his own judgment about himself taking advantage of someone who needed help.&nbsp; Twelve months later, the day he got out of the workhouse, he stopped by my law office (now on University Avenue) to thank me for the counsel I provided.&nbsp; And his step-dad Bert came to think of me as part of the family, even invited me to visit him in Mississippi after he retired from being a mailman.<\/p>\n<p>So plea bargains can help on fairness.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;
